These Terms & Conditions "Terms" govern your use of dominiquelondon.ch (“the Website”) and any purchases you make from Dominique London NV (“Dominique London”, “we”, “us”, “our”). By accessing the Website or placing an order, you agree to be bound by these Terms.

2. ELIGIBILITY AND AGE VERIFICATION
2.1 We do not market or sell tobacco products to anyone under 18 years of age (or the higher minimum age in your jurisdiction).
2.2 By using the Website or placing an order, you confirm you are of legal age where you reside and consent to age-verification checks.
1.3 If you are not of legal age, you must not use the Website or purchase products.
3. HEALTH INFORMATION
3.1 Tobacco use is harmful to health.
3.2 You acknowledge that tobacco use is at your own risk. To the fullest extent permitted by Swiss law, we are not liable for any health effects arising from tobacco use.
4. PRODUCTS, INFORMATION AND CONTRACT FORMATION
4.1 Product descriptions, photographs and specifications are indicative and may not always match the latest packaging.
4.2 All products displayed on the Website constitute an invitation to treat, not a binding offer.
4.3 After checkout, you will receive an automated acknowledgement. This is not an order confirmation.
4.4 A contract is formed only when we confirm availability and send an order confirmation or dispatch notice.
4.5 We may refuse or cancel an order for reasons including availability issues, pricing errors or suspected fraud.
5. PRICES, CURRENCY AND TAXES
5.1 Prices are listed in Euros (€) unless stated otherwise and exclude delivery charges.
5.2 If a pricing error is discovered before dispatch, we may cancel the order and refund any payment.
5.3 If you pay with a non-Euro account, your payment provider may apply currency conversion charges.
6. PAYMENT AND AUTHORISATION
6.1 By placing an order, you confirm that:
- payment information is accurate;
- you are authorised to use the payment method;
- you agree to pay all charges.
6.2 Additional verification may be required to prevent fraud.
6.3 Your payment method may be charged when the order is submitted.
6.4 Payments are processed securely by third-party providers. Full card numbers are never seen or stored by us.
7. SHIPPING, DELIVERY TIMES AND RISK
7.1 Products are usually shipped in original manufacturer packaging.
7.2 Estimated transit times (not guaranteed):
- Switzerland: 2–4 business days
7.3 Delivery times may vary due to customs, transport and postal delays.
7.4 Risk transfers to you on delivery or the first attempted delivery.
8. IMPORT DUTIES AND COMPLIANCE
8.1 You are responsible for compliance with Swiss import laws and any import rules applicable in your region.
8.2 You are responsible for all customs duties, taxes, brokerage fees and delays.
8.3 You confirm that you understand applicable import requirements before ordering.
9. DELIVERY GUARANTEE & EXCEPTIONS
9.1 If the carrier confirms your shipment is lost, we will reship it or provide a refund.
9.2 The guarantee does not apply where non-delivery results from:
- incorrect or incomplete address;
- failure to update delivery details;
- repeated missed delivery attempts;
- tracking showing “delivered”;
- customs seizure or refusal;
- other issues within your control.
9.3 If goods are returned in good condition, refunds may be issued subject to a 10% administrative fee, plus shipping costs.
10. UNDELIVERED ORDERS — NOTIFICATION PERIOD
Claims of non-delivery must be submitted within 30 days of dispatch.
After this period we cannot file a carrier claim and cannot accept liability for non-delivery.
11. CANCELLATIONS, RETURNS & RESTOCKING
11.1 Unused items in original packaging may be returned within 14 days of receipt (excluding delivery costs).
11.2 All approved returns are subject to a 10% administrative fee, plus shipping costs, unless goods are faulty or misdescribed.
11.3 Return shipping is your responsibility unless goods are faulty.
11.4 The cancellation policy does not apply where damage arises from misuse, negligence, alteration or improper handling.
11.5 Your statutory rights under Swiss consumer law remain unaffected.
11.6 Returns must be sent to our Swiss address unless we specify otherwise.
12. PRODUCT IMAGERY AND VARIATIONS
Packaging may vary. Minor discrepancies in images or presentation do not constitute misdescription.
13. WEBSITE USE
13.1 You may use Website materials for personal, non-commercial purposes only.
13.2 You may not:
- create a database using Website content;
- redistribute material without permission;
- remove copyright notices;
- upload harmful or unlawful content;
- attempt to interfere with Website operation.
13.3 Downloads and use of the Website are at your own risk.
14. ENTIRE AGREEMENT & CHANGES
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement.
We may update these Terms at any time by posting a revised version on the Website.
15. LIMITATION OF LIABILITY
15.1 Our total liability for any order is limited to the amount you paid, including original delivery charges where applicable.
15.2 We are not liable for indirect or consequential loss (including loss of profit, goodwill or data).
15.3 Nothing limits liability where it would be unlawful under Swiss law.

17. GOVERNING LAW & JURISDICTION
These Terms are governed by Swiss law.
Disputes shall be subject to the exclusive jurisdiction of the courts of Basel, Switzerland.
